Terms & Conditions for Event Tickets and Event Attendance

These Terms & Conditions apply to the purchase, registration and use of admission tickets for events organised or offered through schulbau.online.

Hereinafter referred to as “SCHULBAU”, “we”, “us” or the “Organiser”.

1. Scope

These Terms & Conditions apply to visitors and participants purchasing, receiving or using tickets or registrations for SCHULBAU trade fairs, conferences, think tanks, seminars, networking events and other events offered through schulbau.online.

They apply to both paid and free tickets unless expressly stated otherwise.

These Terms & Conditions do not apply to exhibitors, sponsors, advertising agreements, magazine subscriptions or other separate commercial agreements unless expressly incorporated into such an agreement.

Event-specific information displayed during the booking process forms part of the respective booking.

If event-specific conditions conflict with these Terms & Conditions, the event-specific conditions shall prevail.

2. Nature of the Service

A ticket provides the holder with a right of admission to the event specified in the booking, subject to these Terms & Conditions and any applicable event, venue, safety and admission rules.

Unless expressly stated otherwise, a ticket does not guarantee:

Programme descriptions, exhibitor lists, speakers, schedules, illustrations and other event information are provided for informational purposes and may be changed in accordance with these Terms & Conditions.

3. Conclusion of Contract

The presentation of tickets on schulbau.online does not constitute an unconditional obligation by SCHULBAU to accept every booking.

By completing the booking process, the purchaser submits a binding request to purchase or register for the selected ticket.

A contract is concluded when SCHULBAU accepts the booking by issuing the ticket, expressly confirming the booking or otherwise accepting the order.

An automatically generated acknowledgement confirming receipt of an order does not by itself constitute acceptance unless it expressly states otherwise or includes the valid event ticket.

SCHULBAU reserves the right to reject a booking before acceptance, including where:

4. Ticket Categories and Eligibility

Certain tickets may only be available to specific groups, including students, schools, public authorities, partners, exhibitors, sponsors or other defined categories.

SCHULBAU may require reasonable evidence that the ticket holder meets the applicable eligibility requirements.

Evidence may be required before the event or at the entrance.

If the ticket holder cannot demonstrate eligibility for a discounted, free or restricted ticket category, SCHULBAU may, where legally permissible:

5. Prices and Payment

The applicable ticket price is the price displayed during the booking process.

Where legally required, prices include applicable VAT.

Payment is due according to the payment method and conditions shown during checkout.

SCHULBAU may use third-party payment service providers.

SCHULBAU is not responsible for interruptions, delays or failures caused exclusively by banks, card issuers or external payment service providers outside SCHULBAU’s reasonable control.

Obvious pricing errors, calculation errors or technical errors do not oblige SCHULBAU to provide a ticket at an obviously incorrect price.

Where such an error is discovered after payment, SCHULBAU may cancel the affected booking and refund amounts already paid unless the parties agree otherwise.

6. No General Right of Withdrawal

Tickets offered by SCHULBAU generally relate to events taking place on a specific date or during a specific period.

To the extent Section 312g (2) No. 9 of the German Civil Code (BGB) applies, there is no statutory 14-day right of withdrawal for such event bookings.

Accordingly, ticket purchases are generally binding once the contract has been concluded.

Any mandatory statutory rights remain unaffected.

7. Cancellation by the Participant

A participant’s inability or decision not to attend the event does not in itself entitle the participant to a refund.

This includes, without limitation, non-attendance caused by:

Unless SCHULBAU expressly agrees otherwise or applicable law requires otherwise, unused tickets are non-refundable.

The applicable Refund and Cancellation Policy forms part of these Terms & Conditions.

8. Transfer of Tickets

SCHULBAU may permit the name associated with a ticket to be changed to another eligible participant.

Any transfer is subject to the applicable ticket category and event requirements.

SCHULBAU may refuse a transfer where there are reasonable grounds to do so, including where:

There is no general entitlement to ticket transfer unless required by applicable law.

9. Resale and Commercial Use

Tickets may not be commercially resold, auctioned, bundled with commercial services or otherwise used for unauthorised commercial purposes without SCHULBAU’s prior approval.

SCHULBAU may cancel tickets that are reasonably believed to have been obtained or offered in violation of this provision, subject to mandatory law.

The use of SCHULBAU tickets for unauthorised competitions, promotions, advertising campaigns or marketing activities is prohibited.

10. Programme Changes

SCHULBAU plans its programmes, speakers, exhibitors and schedules in advance. However, events involve numerous third parties and circumstances that may change.

SCHULBAU therefore reserves the right to make reasonable changes to:

Such changes do not entitle the participant to a refund where the overall nature and essential character of the booked event remain substantially unchanged.

No participant has a contractual entitlement to the appearance or attendance of a particular speaker, exhibitor or other third party unless expressly agreed in writing.

11. Changes to Venue, Format or Organisation

Where reasonably necessary for organisational, operational, safety, regulatory or other legitimate reasons, SCHULBAU may make reasonable changes to the organisation of an event.

This may include:

Where a change materially alters the essential nature of the contractual service, any mandatory rights of the participant remain unaffected.

12. Postponement

SCHULBAU may postpone or reschedule an event where reasonably necessary due to circumstances affecting the planned event.

Unless otherwise communicated, tickets will remain valid for the replacement date.

SCHULBAU may also offer alternative arrangements, including transfer to another event, replacement tickets or credits.

Where applicable law gives a participant a right to reimbursement because of a material postponement, that statutory right remains unaffected.

13. Cancellation of an Event

SCHULBAU may cancel an event where it cannot reasonably be held or where continuation would be commercially, legally, organisationally or practically unreasonable, subject to applicable law.

If a paid event is cancelled without a replacement event or other legally permissible alternative, any refund obligation shall be limited to the amount required under applicable law.

Unless mandatory law provides otherwise, SCHULBAU shall not be responsible for additional expenses incurred by participants in connection with attending or planning to attend an event, including:

Participants are therefore responsible for making their own travel and accommodation arrangements and are encouraged to consider flexible or refundable bookings where appropriate.

14. Force Majeure and Circumstances Beyond SCHULBAU’s Control

SCHULBAU shall not be responsible for failure, delay, modification, interruption, postponement or cancellation to the extent caused by circumstances outside its reasonable control.

Such circumstances may include, without limitation:

In such circumstances, SCHULBAU may take reasonable measures including postponement, relocation, shortening, restructuring or cancellation of the event.

Any mandatory statutory rights regarding payments already made remain unaffected.

15. Admission

Possession of a ticket does not create an unconditional right of entry irrespective of the circumstances.

SCHULBAU and the venue operator may implement reasonable admission, identification, security and safety procedures.

SCHULBAU may refuse admission or remove a participant from the event where there are reasonable grounds, including where the participant:

Where exclusion results from the participant’s own material misconduct, there is generally no entitlement to a ticket refund, subject to mandatory law.

16. Capacity Restrictions

Individual seminars, talks, workshops, networking sessions and event areas may have limited capacity.

A general admission ticket does not guarantee admission to every individual programme component unless expressly stated otherwise.

Access may be provided on a first-come, first-served basis or according to separate registration requirements.

Temporary restrictions imposed for safety, security or capacity reasons do not in themselves constitute failure to provide the event.

17. Personal Property

Participants are responsible for their own belongings.

SCHULBAU does not provide custody or safekeeping of personal property unless expressly agreed.

Liability for lost, stolen or damaged personal property is excluded to the extent permitted by applicable law.

Any cloakroom or storage facility provided by a venue may be subject to separate conditions.

18. Third-Party Services

Exhibitors, caterers, venue operators, hotels, transportation providers and other third parties may provide goods or services independently from SCHULBAU.

Unless SCHULBAU expressly acts as the contractual provider of the relevant service, contracts entered into between a participant and such third parties are solely between those parties.

SCHULBAU does not guarantee the quality, availability, performance or suitability of independent third-party services.

19. Speakers, Exhibitors and Information

Views, statements, presentations, demonstrations, products and information presented by speakers, exhibitors or other participants are generally those of the respective third party.

Unless expressly stated otherwise, SCHULBAU does not endorse or guarantee:

Participants remain responsible for independently evaluating information obtained at an event.

20. Photography, Video and Media

Photography, video recording and other media production may take place at SCHULBAU events.

SCHULBAU may process and use photographs, video recordings and other event media in accordance with applicable law and its Privacy Policy.

Participants must comply with any restrictions communicated in relation to photography, filming, recording or the use of equipment at the event.

Commercial filming, professional photography, live streaming or recording for commercial distribution may require prior permission from SCHULBAU.

Nothing in this section limits rights granted to individuals under mandatory privacy, data protection or personality-rights legislation.

21. Intellectual Property

All SCHULBAU names, trademarks, logos, event concepts, website material and SCHULBAU-produced content are protected by applicable intellectual property law.

Purchasing or receiving a ticket does not grant any licence to commercially use SCHULBAU’s intellectual property.

Materials provided by speakers or exhibitors may be subject to separate intellectual property rights.

Unless expressly permitted, participants may not commercially reproduce, distribute, publish or exploit protected event materials.

22. Website Availability and Technical Errors

SCHULBAU endeavours to maintain the availability and accuracy of its website and booking systems but does not guarantee uninterrupted or error-free operation.

Temporary unavailability, maintenance, transmission errors or other technical interruptions do not create an entitlement to compensation unless SCHULBAU is legally responsible for the relevant damage.

SCHULBAU may correct obvious errors in event descriptions, pricing, availability or other website information.

23. Limitation of Liability

SCHULBAU shall be liable without limitation where liability cannot legally be excluded or restricted, including in cases of:

In cases of simple negligence, SCHULBAU shall only be liable for the breach of an essential contractual obligation whose fulfilment is necessary for the proper performance of the contract and on which the participant may ordinarily rely.

In such cases, liability shall, to the extent legally permissible, be limited to the damage that was foreseeable and typical for the contract at the time the contract was concluded.

Subject to the foregoing and to mandatory law, liability for simple negligence is excluded.

The above limitations also apply to SCHULBAU’s legal representatives, employees, agents and other persons used in performing contractual obligations.

24. No Guarantee of Commercial Results

SCHULBAU provides a platform for information, professional exchange, networking and interaction between participants, exhibitors and other industry stakeholders.

SCHULBAU does not guarantee:

Participants attend and make commercial decisions on their own responsibility.

25. Data Protection

Personal data is processed in accordance with applicable data protection law and SCHULBAU’s Privacy Policy.

Information required to process a ticket booking may be shared with service providers where necessary for payment processing, ticket administration, event operation, security or other legitimate event-related purposes, subject to applicable data protection requirements.

26. Communication

SCHULBAU may send operational communications concerning a booking or event to the email address or other contact information supplied during registration.

Participants are responsible for providing accurate contact information and checking relevant communications before attending the event.

Changes relating to venue, time, programme, admission or other important event information may be communicated electronically.

27. Amendments Required by Law or Event Circumstances

SCHULBAU may update these Terms & Conditions for future bookings at any time.

The version applicable at the time the relevant contract is concluded will generally govern that booking.

SCHULBAU may also make adjustments to an ongoing event relationship where this is reasonably necessary due to changes in law, regulatory requirements, safety requirements or circumstances that could not reasonably have been anticipated when the contract was concluded, provided that the adjustment does not unreasonably disadvantage the participant.

Mandatory contractual rights remain unaffected.

28. Severability

If any provision of these Terms & Conditions is or becomes invalid, unenforceable or ineffective, the validity of the remaining provisions shall not be affected.

The applicable statutory provisions shall apply in place of an invalid provision.

29. Governing Law

The contractual relationship shall be governed by the laws of the Federal Republic of Germany.

For consumers, this choice of law shall not deprive them of mandatory protections granted by the law that would otherwise apply to them.

30. Jurisdiction

Where the contracting party is a merchant, a legal entity under public law or a special fund under public law, Hamburg, Germany shall be the place of jurisdiction to the extent legally permissible.

For consumers, the applicable statutory rules on jurisdiction apply.

31. Consumer Dispute Resolution

SCHULBAU is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board unless required by applicable law.
